Welcome to CallCabinet’s Global Privacy Policy. The protection of your personal information is very important to us. Personal information may be any form of data that could be used to uniquely identify you. This Privacy Policy sets out detailed information on where and how we collect your personal information, what we do with it, how we protect it, and what your rights are. This policy generally applies to our global operations.

CallCabinet is a processor in a B2B (business-to-business) context and our customers are direct users of the CallCabinet Application. Accordingly, to the extent that the EU’s General Data Protection Regulation (GDPR), UK Data Protection Act (UKDPA) or any similar laws apply, our customer will be deemed the “data controller” (under the GDPR, UKDPA and similar laws) of such Customer Data; and CallCabinet will be deemed the “data processor” or “service provider” when processing and storing such data. The CallCabinet Application processes Customer Data, and the personal data contained in it (including voice recordings generated via telephony communications), strictly on our customer’s behalf, in accordance with their reasonable instructions.

Certain privacy and data protection laws require that call recordings may only be initialized pursuant to one or more of the parties’ consent (whether explicit or implicit, depending on applicable law), or subject to certain restrictions. Accordingly, CallCabinet supports these laws by providing the “data controller” with features and options for how they use our Application. The “data controller” is solely responsible for determining how they use our Application and the available features, and to ensure that all individuals using the CallCabinet Cloud Call Recording Application on their behalf or at their request have given their informed consent to these practices and that all legal requirements applicable to the collection, recording and use of data through our Application are fully met by them.

1. Information CallCabinet Collects

To better serve Website visitors, CallCabinet collects several basic types of information from our Website users such as your name, email, job title, telephone number, and telephony platform which you provide to us through form submissions, events, feedback, and inquiries.

As the “data processor” CallCabinet logs the following information related to the data subject: date and time of the call, caller ID and telephone number. In relation to PCI DSS compliance, additional financial information provided during the conversation with the data controller is redacted from the call audio and call transcription.

CallCabinet does not rent or sell any of this information to anyone. 

(a) Personally identifiable information: This is information that personally identifies one individual from another. This information is voluntarily provided to us by you and is used by us for the purposes described herein. CallCabinet does not rent or sell any of this information to anyone. We also log user’s IP addresses which are transmitted to us when viewing the Website and your date and time of use each time you use the Application.

(b) Aggregate user and tracking information for Sponsors: This information is an aggregate of all users of the Application and may include gender, age, friend or follower count, location of each use and other demographic information. This information may be used in marketing or reports for Sponsors to demonstrate usage of the Application and its appeal and effectiveness.

(c) Aggregate user and tracking information for CallCabinet: This information gives us insights into how our Application users and Website visitors use our site, our Application and our other products. This data is anonymous in nature and does not contain any personally identifiable information. We use this information to ensure that the Website, the Application, emails and marketing efforts continue to appeal to our Sponsors, users and others.

(d) Other Information CallCabinet Collects: When you visit the Website, we automatically collect some information about your visit using cookies, web beacons, log analysis software and other aggregate tracking technologies. When you use the Application, CallCabinet collects information about your mobile device so that CallCabinet can continue to develop the Application to work on a broad number of devices.

2. Credit Card Privacy Policy

(a) CallCabinet will collect and use information obtained from credit card transactions only for business purposes. These business purposes include the payment of amounts due to CallCabinet, from time to time.

(b) The credit card information provided by you to CallCabinet will be stored in a confidential manner. Our employees may access such information only when there is an appropriate business reason to do so, such as when a charge is due to CallCabinet, when refund must be issued back to the credit card or when there is an issue or dispute as to charges made on the credit card. We maintain physical, electronic and procedural safeguards to protect your information, and our employees are required to follow these privacy standards.

(c) CallCabinet does not disclose any nonpublic information (such as credit card number and their expiration dates) about our customers or former customers to anyone, except as required by law. We disclose information only when it is necessary for the conduct of local, state or federal government business, or under circumstances where disclosure is required by law. Information may also be disclosed for audit purposes, to regulatory agencies or for other general administrative services. We do not disclose information about you to other entities who may want to sell their products to you.

(d) When processing credit card information, Call Cabinet’s website uses Secure Socket Layer (SSL) protocol to ensure transaction security.

3. Cookies

Cookies are files that contain small amounts of data. If your browser is configured to accept these files, they are stored on your computer’s hard drive. CallCabinet uses these data files when you visit our Website to anonymously identify you. By using cookies, CallCabinet is able to:

(a) Completely support and enhance your visit to our Website.

(b) Allow you to access your account information without requiring you to answer your sign-in question multiple times during the same visit to our Website.

(c) Ensure that you won’t see the same promotions too often.

(d) Better measure how many users view and navigate our Website.

(e) Better measure how effective our online marketing campaigns are performing.

If you wish, you may set your browser to refuse cookies. However, by refusing to accept a cookie, you will not be able to access some pages on CallCabinet. Since many websites use some form of cookie technology, setting your browser to refuse cookies may restrict your access to certain information or product offerings on those websites. Some CallCabinet cookie files remain on your computer’s hard drive until you manually delete the file. CallCabinet cookie files do not contain personally identifiable information or track an individual users’ movement through our Website. A CallCabinet third-party advertiser cookie file may also be placed on your hard drive during your visit to our Website. The purpose of these types of cookies is to collect aggregate statistics about your visit to our Website. These cookies do not contain personally identifiable information or track an individual users’ movement through our Website.

4. Tracking Pixels

As a means of measuring the efficacy of the online advertising and marketing campaigns that CallCabinet employs, we may also allow third-party advertising companies to use a single-pixel image file on our Website to collect information about your visit. This information is anonymous in nature. It only identifies actions being performed on our Website. It does not tie actions back to any individual user of our Website. No personally identifiable information is collected during this process. Certain CallCabinet marketing and confirmation emails may also contain a single-pixel image file to detect when and whether you’ve opened the email. CallCabinet may also track clicks from email communications using an internal or third-party tracking system. CallCabinet uses this personal information to continually assess and improve the Application we offer.

These tracking mechanisms are used to ensure that the Website and emails continue to provide relevant content that is interesting and useful to our users.

5. Log File Analysis

CallCabinet also collects information from your Equipment, End User Equipment or another computer each time you visit our Website using javascript and log file analysis software. Information we measure, analyze and collect in this manner may include: your IP address, screen resolution, operating system, platform information, your URL clickstream behavior (from the referring URL website, through the Website, to and including the URL of existing website), date and time of your clickstream behavior, purchase behavior, clickstream patterns, e-mail address, CallCabinet user answer, cookie information, session information (includes: page interaction information, browser interaction information, page response times, length of visits to individual pages, download errors) and web browser software. Though some personally identifiable information may be collected in this process, the information collected is not used to track an individual’s use through our Website. However, we do collect IP addresses, which are unique to each user and can be used to identify and locate an individual user. IP addresses are used used to prevent fraud and may be turned over to credit card agencies or law enforcement agencies.

6. How Does CallCabinet Protect Your Information?

We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.

We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Database to be only accessed by those authorized with special access rights to our systems, and are required to keep the information confidential.

After a transaction, your private information (credit cards, social security numbers, financials, etc.) will be kept on file for more than 60 days in order to better personalize the messages that are displayed to you, and to help us identify loyal users who may qualify for additional Machine credits.

CallCabinet Cloud System uses 256-bit encryption and each call recording is encrypted before being transferred. When transported by your organization to the CallCabinet Cloud System, all of your data is stored using encryption keys specific to your organization. All data is backed up daily and is redundant across multiple geographic locations.

7. Children’s Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age and do not wish to do so. Our Website, Application and Services are all directed to people who are at least 18 years old or older.

8. Information from Third-Party Sources

CallCabinet may periodically add or update information about you obtained from third-party sources. Examples include updated address, business address or other information from such business partners or other third parties; or credit history information from credit bureaus.

This information can help us accurately fulfill requests and deliver messages to you.

We also receive aggregate information such as page views, search terms and click-through information from sources, such as companies we advertise with.

9. How CallCabinet Uses the Information We Collect

CallCabinet may use your information, including personally identifiable information, for business purposes including, without limitation, for the following business purposes:

(a) Answers to your questions.

(b) To improve the quality of your Website visit.

(c) To complete your request.

(d) To notify you of any changes to your requests.

(e) To create your CallCabinet user account on our servers.

(f) To send marketing communications and purchase confirmations that you have opted-in to or otherwise agreed to receive.

(g) To send surveys to you.

(h) To update your user account with any information we receive from you or from third-party sources about you.

(i) To post Messages to your account and publish, market and distribute those Messages as contemplated in the Application.

Additionally, CallCabinet may use your personal information and non-personally identifiable information it collects during your Website visit, Application usage, during your interaction with our e-mails or during your interaction with our third-party marketing efforts for other purposes including without limitation, the following:

(a) To provide marketing reports, demographic reports and other information to Sponsors to demonstrate the effectiveness of CallCabinet and usage and of individual Messages.

(b) To better monitor in the aggregate the effectiveness of our Messages, advertising and marketing campaigns.

(c) To better monitor in the aggregate how visitors and users are using our Website.

(d) To ensure that our Application, Website and email communications continue to provide relevant content that is interesting and useful to our Sponsors and users.

(e) To uncover and diagnose problems with our servers.

(f) For day-to-day system administration needs.

10. GDPR Disclosure

You may exercise these rights to the extent these rights apply to you by contacting CallCabinet via email. We will respond to your request within the time frame prescribed by applicable law.  Although CallCabinet will make reasonable efforts to accommodate your requests, in some circumstances we may deem your request unfounded or not eligible under applicable law. If that should happen, CallCabinet expressly reserves the right to refuse your personal data request. Before CallCabinet is able to accommodate any request, provide you with any information or correct any inaccuracies we will verify your identity by requesting certain information or identification.

In the instance of CallCabinet acting as a “data processor” or “service provider”, you will need to exercise your rights directly with the “data controller”.

GDPR Provides Individuals with Eight Rights:

(a) The right to be informed

Organizations need to tell individuals what data is being collected, how it’s being used, how long it will be kept and whether it will be shared with any third parties.  This information must be communicated concisely and in plain language.

(b) The right to access

Individuals can submit data access requests, via email which obliges CallCabinet to provide a copy of any personal data concerning the individual. CallCabinet has one month to produce this information, although there are exceptions for requests that are manifestly unfounded, repetitive or excessive.

(c) The right to rectification of inaccurate personal data

If the individual discovers that the information CallCabinet holds on them is inaccurate or incomplete, they can request that it be updated. As with the right to access, CallCabinet has one month to do this, and the same exceptions apply.

(d) The right to erasure (also known as ‘the right to be forgotten’)

Under certain circumstances, individuals can request that CallCabinet erase their data such as when the data is no longer necessary, the data was unlawfully processed or it no longer meets the lawful ground for which it was collected. This includes instances where the individual withdraws consent.

(e) The right to restrict processing of your personal data

Individuals can request that organizations limit the way they use personal data. It’s an alternative to requesting the erasure of data, and might be used when the individual contests the accuracy of their personal data or when the individual no longer needs the information but the organization requires it to establish, exercise or defend a legal claim.

(f) The right to data portability

Individuals are permitted to obtain and reuse their personal data for their own purposes across different services. This right only applies to personal data that an individual has provided to the “data controller” by way of a contract or consent.

(g) The right to object to the processing of personal data for direct marketing purposes

Organizations must stop processing information unless they can demonstrate compelling legitimate grounds for the processing that overrides the interests, rights and freedoms of the individual or if the processing is for the establishment or exercise of defense of legal claims.

(h) Rights related to automated decision making including profiling

The GDPR includes provisions for decisions made with no human involvement, such as profiling, which uses personal data to make calculated assumptions about individuals.

There are strict rules about this kind of processing, and individuals are permitted to challenge and request a review of the processing if they believe the rules aren’t being followed.

11. Data Retention Practices

Subject to your right to deletion as required by law, we will retain your information for as long as is reasonably necessary to engage with you in relation to the interaction for which we collected your information or as otherwise permitted by applicable law. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and to enforce our agreements. This policy applies if you interact with us through our websites, on social media, or at events, trade shows or webinars. 

In the instance of CallCabinet acting as a “data processor” or “service provider”, the data retention policy configuration is managed and controlled by the “data controller”.  After the “data contoller’s” retention policy has expired, CallCabinet deletes all call recordings, metadata and transcripts from the Application immediately.

12. Additional Uses of Personally Identifiable Information

Additionally, CallCabinet may use your information, including personally identifiable information, for special purposes. Below are a few examples of special purposes:

(a) In disclosures to law-enforcement agencies when required by law.

(b) In disclosures to law-enforcement agencies and/or credit card companies in cases of fraud or in other cases where an individual poses a threat to the interests of CallCabinet, its users or its Sponsors.

(c) To resolve disputes.

(d) In some cases, we may choose to buy or sell business assets. In these business transfers, user information, including personally identifiable information, is typically one of the business assets that is transferred. Moreover, if CallCabinet, or substantially all of its assets were acquired, or in the unlikely event that CallCabinet goes out of business or enters bankruptcy, Application and Website user information, including personally identifiable information, would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of CallCabinet may continue to use your personally identifiable information as set forth in this Privacy Policy.

(e) From time to time, CallCabinet may enter into agreements with third-party providers for web analytic and other similar software. If CallCabinet enters into such an agreement, CallCabinet may share your information, including personally identifiable information, with the provider or such provider may have access to and collect your information on behalf of CallCabinet. Your information, including personally identifiable information, may be stored with the provider. Before sharing or storing any user information with a third-party provider, CallCabinet shall use commercially reasonable attempts to ensure that any provider agrees to comply with the Terms of this Privacy Policy, however, there is no guarantee that said third-party will not breach this Privacy Policy. Additionally, CallCabinet generally requires any third-party provider of web analytic or other similar software to maintain industry security standards to protect your information. In the event any third party provider discloses your information or breaches this Privacy Policy, you agree (i) CallCabinet shall have no liability or responsibility for such breach; and, (ii) you agree to look solely to said third-party provider to recover any damages you may incur as a result of said disclosure.

(f) If you prefer your web browsing patterns on the Website to be tracked anonymously or if you prefer for your web browsing patterns to not be tracked in this way, or if you prefer that your personally identifiable information and Social Media Site information not be used by CallCabinet as provided herein, then you are not authorized to use the Website or the Application and you are directed to leave the Website and cease using the Application immediately.

13. What You’ll Receive from CallCabinet

CallCabinet believes that clear communications with our Application and Website users is a key part of a great user experience. We only want to send you communications that you expect to receive or that you have requested. All of our email contains clear information on how to unsubscribe, and we honor all requests as quickly as possible. Below are examples of types of communications you may receive from us.

(a) User connection confirmation email messages. When you create or update your Application Account you may receive an email confirmation.

(b) Email and Postal mail. CallCabinet may also send you email or postal mail notifications containing surveys, promoting special Products or informing you of other promotions.

(c) Answering your inquiries. If you send us or phone in a question or offer a suggestion, we will use your email address, telephone number, or postal address to respond to you.

14. What Information CallCabinet Shares

(a) Except as provided in these Terms, CallCabinet does not rent or sell any of your personally identifiable information to anyone.

(b) If you have selected payment by credit card or other electronic payment applications, CallCabinet may share personally identifiable information to third party financial institutions to collect such payments as they become due.

(c) CallCabinet may share personally identifiable information to third party corporate subprocessors like QuickBooks, HubSpot, who provide or offer other applications on our behalf. This data sharing pertains to CRM data which we hold as ‘Controller’ and is shared in compliance with privacy laws and electronic communication regulations. The personal data we hold as ‘Processor’ which includes communications data and call recordings is solely governed by the terms of our data processing agreement with the customers and shall not be shared to any third party without customer consent.

15. Video and Photography

CallCabinet will be taking photographs and video in public areas of any events you may register to attend (session rooms, lunch and learns, exhibit halls, trade shows, conventions, etc.). We may use such media in marketing materials, educational products and publications. Your image and the sound of your voice may be recorded. If you are identified during the recording, or identify yourself by name, that information may be included in our materials. Recordings may be edited, copied, exhibited, published or distributed.

16. Changes to the CallCabinet Privacy Policy

From time to time, CallCabinet may update and amend the terms of this Privacy Policy. Changes will take effect once they are posted online. We will provide prior notice if we believe any substantial changes are involved via any of the communication means available to us or via the Website, Applications and/or Services. After such notice period, all amendments shall be deemed accepted by you. If you do not agree with any of the amended terms, you must avoid any further use of the Website or Application.
